BT 4000 Smokemeter App Terms and Conditions

1. Agreement to Terms

By downloading, installing, or using the BT Smokemeter app (the App), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use the App.

2. App Functions

The App allows users to:

• Operate a Bluetooth-enabled sensor connected via serial port
• Scan barcodes or documents using the device camera
• Access and modify PDF documents
• Enter and save user data, including tester information, vehicle details, test site data, and test session results
• Generate and store test reports locally
• Access and transmit information to and from the California Air Resources Board (CARB) website
• Upload or retrieve data via a secure cloud database

3. Permissions and Data Storage

• Camera Access: For scanning VINs, barcodes, or documents
• Storage Access: To read/write test files, PDFs, and reports
• Bluetooth Access: For connecting to the smoke meter sensor
• Internet Access: To communicate with CARB and check for software updates

The App locally stores tester name, VIN, test results, vehicle data, and test site information. Data is stored only on the device unless explicitly exported or uploaded. Beryl Technologies, LLC does not collect or transmit user data unless required for technical support or regulatory compliance. Users are responsible for backing up and protecting their own data.

4. Compatibility and Device Issues

The BT Smokemeter app is developed for Android operating systems. Beryl Technologies, LLC makes every effort to ensure compatibility with supported Android versions; however:

• Android OS or tablet firmware updates may break app functionality. We cannot guarantee operation on newly released Android versions or device updates until compatibility is confirmed.
• Tablet theft or loss may render the meter inoperable. The App and associated hardware may require device re-registration or a factory reset.
• Users are responsible for keeping their device secure and software up to date.

Device Model Variations:
Tablet models and configurations may vary (Enterprise Edition vs. standard retail). As a result, warranty coverage, service channels, and update policies may differ by model and SKU. Refer to the manufacturers published terms for your specific device.

5. Warranty Coverage

The BT Smokemeter system is governed by the same limited warranty policy as the BT 2000.

• Hardware Warranty (BT Meter, Sensors, Pole Assembly): One (1) year from shipment under normal use.
• Consumables Warranty (batteries, cables, keyboards): One (1) year from shipment.
• Software Media Warranty: One (1) year from shipment against defects.
• Tablet Warranty (Third-Party Device): Tablets (e.g., Samsung Galaxy Tab Active5) are covered only under the manufacturer warranty. Enterprise Edition units may differ in coverage and duration. Warranty claims must be made directly with the manufacturer or original seller; Beryl can provide proof of purchase upon request.

Conditions for Warranty Validity (BT Hardware):

• A completed warranty registration must be submitted within 60 days of purchase.
• Returns require a valid RMA number issued by Beryl Technologies, LLC.
• Products may be returned within 7 days of purchase in unused condition (test counter less2) for refund. Leasing purchases are excluded.
• The sole remedy is repair or replacement of warranted BT hardware; shipping for warranted repairs is covered by Beryl Technologies, LLC.

6. Exclusions and Disclaimers

Beryl Technologies, LLC does not warrant against:

• Incompatibilities caused by new Android OS versions or tablet updates until compatibility is confirmed
• Re-registration or factory reset requirements following loss, theft, or hardware replacement
• User failure to maintain device security or timely software updates
• Damage from misuse, improper installation, unauthorized repairs, or third-party accessories/software

Software is provided as is. Beryl Technologies, LLC disclaims all implied warranties, including fitness for a particular purpose and merchantability, unless otherwise required by law.

7. License and Regulatory Submissions

The App is licensed (not sold) to users. The license is non-transferable and may be revoked if:

• The user violates any term of this agreement
• The software is altered or reverse-engineered
• The device is deemed compromised or misused

Regulatory Submissions:
The BT Smokemeter has been pre-approved by the California Air Resources Board (CARB/ARB). Pre-approval does not guarantee acceptance of any individual submission. Acceptance or rejection of submissions is solely at the discretion of CARB/ARB. Beryl Technologies, LLC is not liable for rejected submissions or related compliance issues.

Any falsification, fraud, or misuse involving CARB submissions (including tampering with test data, identities, or timestamps) will result in immediate suspension or termination of access and may be reported to authorities. Beryl reserves the right to disable the license on affected devices and retain logs as permitted by law.

Upon termination, the user must uninstall and cease use of the App. Users may not reverse engineer, decompile, disassemble, or attempt to derive the source code, firmware, protocols, or schematics of the Module, Meter, or Sensor. The Module is designed solely for use with the supplied unit.

8. Limitation of Liability

In no event shall Beryl Technologies, LLC or its affiliates be liable for damages exceeding the original purchase price of the product or App. This includes damages related to lost data, business interruption, or legal claims from improper use of test data.

9. Updates to Terms

These Terms may be updated at any time without prior notice. Continued use of the App after changes constitutes acceptance of the new terms.

10. Governing Law

This agreement is governed by the laws of the State of California, USA. Disputes will be handled under California jurisdiction unless otherwise agreed in writing.

11. Support

To request warranty service, obtain RMA authorization, or report software issues, visit the Support page.

12. Data Privacy

• 12.1 Local Data Only: All data is stored only on the users device unless exported or transmitted.
• 12.2 No Tracking or Analytics: The App does not use analytics, ads, GPS location, or third-party tracking.
• 12.3 User Control: Users can view, modify, export, or delete their data. Beryl retains no personal data unless provided for support.
• 12.4 Security Notice: Users are responsible for securing their tablet, backing up data, and preventing unauthorized use.
• 12.5 Legal Compliance: Beryl complies with applicable data protection laws, including CCPA principles. Users may request access, deletion, or export of their data through the Support contact form.

13. Acceptance of Terms

By using this App, you confirm that you have read, understood, and agreed to these Terms and Conditions, including the Data Privacy policy.

Note: The operator is responsible for verifying that the correct maximum smoke opacity is set for each vehicle.  The ARB is moving to an OBD system; please refer to the ARB website for more information.  Beryl Technologies will not be liable for any incorrect maximum smoke opacity limit.  After all smoke tests, always print a hard copy of the test.  Always verify that all data items were properly inputted and printed. Download the data from the meter after each test or at the end of the day.  We recommend downloading the data at the end of each day and verifying that all smoke tests performed during the day were added to the smoke test database.  Always use a secure and redundant backup system for test data storage.  Beryl Technologies will not be liable for any lost or corrupted data.  By submitting forms or sending emails to Beryl Technologies LLC, you consent to receive SMS or MMS messages from us.
